Liability
To
the full extent allowed by applicable law, you agree that we will not
be liable to you/or any third party for any consequential or incidental
damages however caused (including but not limited to loss of revenue,
loss of profits, loss of anticipated savings, financial loss, wasted
expenditure, loss of privacy and loss of data) or any other indirect,
special or punitive damages whatsoever that arise out of or are related
to the freerose.co.uk Site. (“financial loss" in this sense does not
refer to the price you have paid for the goods, which we may be liable
to refund to you, in whole or in part, if the goods are faulty or do
not comply with their description). Freerose Limited' liability in
respect of all other losses shall be limited to the invoiced amount of
the relevant order, provided it has been paid

warranties or guarantees. You must bear the risks associated with the
use of the Internet.
The
freerose.co.uk Site may from time to time provide content from other
Internet sites or resources and while Freerose Limited tries to ensure
that material included on the freerose.co.uk Site is correct, reputable
and of high quality, it cannot accept responsibility if this is not the
case. Freerose Limited will not be responsible for any errors or
omissions or for the results obtained from the use of such information
or for any technical problems you may experience with the
freerose.co.uk Site. If Freerose Limited is informed of any
inaccuracies in the material on the Site we will attempt to correct the
inaccuracies as soon as we reasonably can.
In particular, we disclaim all liabilities in connection with the following:

Returning Faulty Items
With
some products the manufacturer deals directly with warranty claims and
this should be mentioned within your product documentation.If you are unsure how the fault should be handled please send an email to returns@freerose.co.uk detailing the product and your query.
If you wish to return a faulty item, please email returns@freerose.co.uk detailing the fault and requesting a RAN number. Telephone requests to return faulty items cannot be accepted.
Freerose Limited cannot accept liability for returned packages damaged during
transit. It is the Customer's responsibility to protect the product
adequately to prevent damage.
We
will then issue you with a Return Authorisation Number (RAN), which
will allow us to trace and match your return to your account with us. Please
note it is essential that the RAN number is clearly stated on the
returned package(s) and mentioned in all associated correspondence. Failure to mention the RAN number will cause delays.
All
returned goods must mention the Freerose Limited Authorisation
Number (RAN) which must be obtained for each item to be returned.
The
return of any item is the responsibility of the customer so we
therefore advise you to send the item(s) back by some form of recorded
delivery method, as proof of postage is not proof of delivery. We also advise you to ensure the goods are adequately protected, packaged and insured for their return journey
On receipt of the returned product, we will test it to identify the fault you have notified to us.
If
following the testing process, the product is found to be in good
working order without defect, we will return the product to you, and
the carriage costs of this return will be your responsibility. Please
note that if you have, in the meantime, required us to provide you with
a replacement product before completion of the testing process, you
will have to pay for this product also.
This
warranty shall not apply if the goods have been worked upon, altered or
damaged in any way by the Customer or its employees or agents, or to
goods not used in accordance with the manufacturer's instructions.
Unless
otherwise stated in the manufacturer's documentation, all goods
delivered to a UK mainland address carry a 12-month manufacturer's
warranty. Customers who wish to make a warranty claim must comply with
the manufacturer's instructions and warranty procedure. In order to
resolve your problem as quickly as possible, we may refer you to the
product manufacturer who will deal directly with the return.In these instances, we will provide you with the contact information for the relevant manufacturer.If you are a consumer, this does not affect your statutory rights.
Some
manufacturers require goods to be returned within 14 days or less in
order to secure refund. In such instances the manufacturer's time limit
will apply and therefore Manic Deals will only accept a return within
14 days of purchase or the manufacturer's time limit, if that limit is
less than 14 days.
We
can only accept the return of a product that does not meet the
description, if they are returned to us within 14 days. Beyond that
period you will be deemed to have accepted the goods and you must
therefore check the goods promptly on receipt. Please note that this
period is reduced to 7 days for clearance offers.
Health and SafetyIn
accordance with the prevailing Health and Safety at Work Act and
Consumer Protection Act, Freerose Limited confirms that the goods it
supplies as a distributor do not present a hazard to health and
safety:-
(a) when properly used for the purpose for which they are designed; and
(b) if the Customer takes reasonable and normal precautions in their use.
Nothing
in these Terms and Conditions shall exclude Freerose Limited's
liability for personal injury or death caused by its negligence.
Force Majeure
Where,
in spite of its reasonable efforts, Freerose Limited is unable to
perform an obligation due to force majeure, it shall not be deemed to
be in breach of its contract with the Customer.
Special Rules for Clearance Bargains
Goods
sold as 'Clearance Bargains' are downgraded goods that Freerose Limited
is able to offer at a discount on the normal site price. Stocks of
goods offered as Clearance Bargains are limited and such goods are sold
subject to the following special rules. These special rules apply in
addition to, and in the event of any conflict override all of Freerose
Limited’s other terms and conditions.
Clearance
Bargains are graded according to the condition of the goods, which is
described at the point of sale. The length of the guarantee (if any),
with the benefit of which the goods are sold, is specified in the
description of the relevant item.
Freerose
Limited makes every effort to ensure that Clearance Bargains are sold
on a 'first come, first served basis'. However, the customer accepts
that the goods may for some reason become unavailable at any time prior
to delivery, in which case Freerose Limited reserves the right to
refuse the offer to purchase or rescind the contract. In the event of
the cancellation of the sale in these circumstances, Freerose Limited'
liability is limited to the return of the purchase price paid by the
customer if payment had already been taken. Please note it is policy
not to take payment before the goods are ready to ship.
Products are non-returnable unless we have made an error or the goods are faulty;
- quoted prices are valid only whilst stocks last , and
- quoted prices are not subject to value, cash or volume discounts.
Our
acceptance of an order takes place on despatch of the order, at which
point the purchase contract will be made and you will be charged for
your order.
Third Party Websites
As
a convenience to Freerose Limited customers, the freerose.co.uk Site
may include links to other web sites or material which are beyond its
control. Freerose Limited is not responsible for content on the
Internet or World Wide Web pages on any other site outside the
freerose.co.uk Site.
Advertising and Sponsorship
Part
of the freerose.co.uk Site may contain advertising and sponsorship.
Advertisers and Sponsors are responsible for ensuring that material
submitted for inclusion on the freerose.co.uk Site complies with
relevant laws and codes. We will not be responsible for any error or
inaccuracy in advertising and sponsorship material.
Applicable Law
These
Terms and Conditions shall be governed by and construed in accordance
with the laws of England and any disputes will be decided only by the
English courts.
International Use
Freerose
Limited makes no promise that materials on the freerose.co.uk Site are
appropriate or available for use in locations outside the United
Kingdom, and accessing the freerose.co.uk Site from territories where
its contents are illegal or unlawful is prohibited. If you choose to
access this site from locations outside the United Kingdom, you do so
on your own initiative and are responsible for compliance with local
laws.
